Procurement also spearheads other efficiency-building factors, including electronic automation tools (VMS, Services Procurement technology etc.) Organizations with a centralized Procurement function must recognize this demand in their organization and find a solution to engage these micro-businesses seamlessly, safely, and efficiently. Second: the legal perspective. This one was more holistic. “Why can’t we all just work together,” asked Deb Berns, the General Counsel at UnitedHealth Group. She cited how the business and other supporting stakeholders all need to collaborate and work with a common set of governance rules to ensure ICs are properly classified and the overall risk for the organization is mitigated. Issues like systems security, immigration laws, employment regulations, and general company policies must be accommodated for within IC engagement policies and processes. There are concerns that no single entity would be able to watch over an entire organization’s safekeeping when it comes to using ICs, so everyone has to have the company’s best interest in mind and follow the rules established by a joint committee of stakeholders from across the enterprise. Then, as the call progressed, something unexpected happened – HR representatives started to perk up. ICs, they claimed, are talent and talent is the job of the HR department. Ann Odehnal from WellPoint listed several reasons why HR has to take the lead. It’s all about the talent, she stated, and HR departments have access to the best. Often times the best talent – the most experience, the best training, the top advisory and specialized skills – are presented by ICs. Typically, these are people who don’t want a full-time job and are not interested in being temps. They want to offer their skills and experience with a different degree of involvement. The HR audience seemed to agree. But again, who owns it? Odehnal offered her take. “I believe the risk is not who owns it, but how it’s managed,” she said. “If it’s a throw-away process, it doesn’t matter who is the owner. If the org that does own it manages the necessary activity like it’s important and has the power to enforce the requirements and support the business need, then it’s in the right place,” She is convinced there are reasons for HR to take charge, but it is really the process that need ownership. And that depends on the organization. So maybe centralized management is the answer… and maybe HR is the right area under which to centralize. After all, if you want to sell IC engagement solutions to businesses, see who is best aligned to provide these benefits: Centralized contracting (including the use of a template for the creation of a good SOW). Legal has to be consulted so there is consistent messaging and buy-in at the highest level. And of course no program works unless the executives lead by example; after all, most ICs actually come from the needs of the “C” suite. Then bringing in representatives from A/P and Finance, the IT department, Marketing, and Engineering should give you a good cross-functional team that will cover every element of the process, touch every major user group, and consider every box in the workflow chart. Lowest Price Technically Acceptable (LPTA) procurements have been a hot topic in the federal government contracting industry for the past two years. Contractors have lamented that LPTA, as it is commonly referred to, is stifling innovation, driving down prices and, at times, being used for the wrong types of federal procurements. To gauge the impact of LPTA procurements on government agencies and the contractors who serve them, Centurion Research Solutions and Market Connections, Inc. have partnered to produce an in-depth study of government LPTA procurements, perceptions of LPTA among government and contractors and LPTA's effect on the development and delivery of solutions to government. 360 federal government decision makers involved in selection of contractors and vendors in some way, and 375 government contractor employees were surveyed regarding their perceptions of Lowest Price Technically Acceptable (LPTA) federal procurements. The Joint Contracts Tribunal provides suites of standard forms for procurement processes and Main contracts in construction; the 2011 edition is the most current. JCT contracts are the most widely used in the UK construction industry. The procurement process needs clients and contractors to be aware of their roles and obligations, so that they use the right standard forms and contracts to mitigate risks for all involved. The JCT suite recognises three procurement processes; Traditional or conventional, Design and Build and Management. Traditional is where the design and construction elements are provided sequentially, by different organisations. Design and build procurements, have a single main contractor appointed to deliver both elements. In Management procurement the main contractor is paid a fee for defining and managing the construction process. The choice of procurement process will take account of a range of factors such as whether the project is a new build or refurbishment, or if it needs specialist construction skills. There are eight JCT Main contracts; Lump Sum, Measurement, Cost reimbursement or cost plus, Design and Build, Management Contract, Partnering Contract, a Pre-Construction Services Agreement, and a Consultancy Agreement. There are also variants to the eight Main contracts. The JCT has recognised the potential complexity of this variety of options, and published a flowchart to help clients decide which contract is the best fit for them. A JCT contract and the relevant suite of standard forms are consistent documents. If clients or even contractors introduce bespoke amendments to the forms then the balance of risks, the integrity and even the legality of the contract may be compromised.
